A recently filed class action case against Ford Motor Company is proof that legal filings can occur without notice and eventually force current and former owners of Fiesta and Focus vehicles equipped with the PowerShift transmission to make critical decisions about their legal rights. Though that case was dismissed, it can still be refiled. While public knowledge surrounding issues with this transmission has increased due to consumer complaints online and nationally circulated investigative reporting, legal matters have so far been largely limited to the 2011-16 DPS6 settlements and individual claims for newer models. That will soon change, we suspect, if Ford agrees to settle a class action lawsuit on terms that we believe would significantly impact hundreds of thousands of owners and former owners of these vehicles. If you are a current or former owner of an automatic transmission, 2017-19 Ford Fiesta or Focus vehicle, it will be critical that you understand your legal options before time runs out.


A history of issues

The Ford Fiesta was first released with a DPS6 PowerShift transmission in 2011. Through 2019, these vehicles faced a wide range of problems with acceleration, shuddering, failure to engage, and more. First launched with the same transmission in 2012, and only available through 2018, DPS6-based Ford Focus vehicles experienced the same problems widely reported online, in showrooms and service centers, and in the garages and driveways of owners nationwide. The impact of PowerShift transmission failures on owners has been undeniable. Our firm hears from people daily who purchased their Ford vehicle expecting a safe, reliable automobile and have instead faced worrisome driving experiences, complete transmission failures and costly repair bills. What’s worse, the need for dependable transportation has forced many owners to become former owners, taking on significant debt and financial liability in order to get out of their Ford Fiesta or Focus and into a different vehicle.

Issues with the 2017-19 Ford Fiesta and Focus transmission have persisted despite the manufacturer’s continued insistence that there is not an inherent problem with the PowerShift system. This is completely inexcusable and false in the opinion of thousands of clients we have represented.
